- all partners of the business name holder agree to the change; and
- the change on is permitted by an agreement between the partners which provides for the continued existence of the partnership (business name holder) in the circumstance that a partner is ceased, replaced or added to the partnership.
You will also be asked if the partner is being removed because they are deceased.
Adding or removing a joint venture partner
You cannot add or remove a joint venture partner to your business name holder details. This is because changing the collection of entities behind the joint venture changes the holder itself. If your joint venture changes you must cancel your business name and give consent to register the same name to the new joint venture partnership. Each joint venture partner must provide an ABN when applying to register.
